Terms of service

These Terms of Service govern your use of the Create It 3D online store and the purchase of products or services from Create It 3D (Pty) Ltd. They must be read with the applicable quotation, order confirmation, Returns & Refund Policy, Shipping & Delivery Policy, Warranty Policy and Privacy Policy.

Products are sold online. The operating studio is not a walk-in retail store.
2. Using the website
You may use the website for lawful shopping, quotation, support and information purposes. You may not interfere with the site's security or operation, use automated means in a way that creates an unreasonable load, submit unlawful or harmful material, impersonate another person, or infringe any third-party right.
Product information, guides and automated recommendations are general information. They do not replace a written engineering specification, safety assessment or professional advice where the application requires one.
3. Product information and availability
We take reasonable steps to keep descriptions, images, compatibility information, prices and availability accurate. Screen colours, manufacturer images and minor specification changes may differ from the delivered product. If a material error affects your order, we will contact you and offer an appropriate correction, alternative or refund.
Placing an item in a cart does not reserve stock. An order is accepted when we confirm it or begin fulfilment, subject to payment confirmation, availability, fraud and verification checks, and any lawful restriction. We may decline or cancel an order for a genuine pricing or listing error, unavailable stock, suspected fraud, legal restriction or inability to deliver, and will refund amounts paid for a cancelled order as required by law.
4. Prices and payment
Prices are shown in South African rand. The checkout or written quotation will disclose the product or service price and any delivery, freight or other charge before you commit. Tax will be stated where applicable; no amount may be represented as VAT unless Create It 3D is registered and legally entitled to charge it.
Online product orders normally require full payment. Service work normally requires full payment unless the quotation provides for a deposit, such as 50% for a larger project. Where a deposit is agreed, the balance must be paid by the milestone shown on the quotation and, unless agreed otherwise, before dispatch or release of final production files.
A quotation or pro-forma is valid until the expiry date stated on it. It is not a tax invoice and does not by itself confirm stock or a production slot unless the document expressly says so.
5. Reviewing and correcting an order
Before completing an online order, you can review the items, quantities, delivery details and total price and correct errors. If you notice an error after placing the order, contact us immediately. We will try to correct it before fulfilment, but changes may not be possible after a supplier order, custom production or courier booking has started.
6. Delivery
Delivery coverage, estimates, freight exclusions, tracking and risk are set out in our Shipping & Delivery Policy. Unless a different period is agreed, electronic orders are executed within 30 days as required by ECTA. Goods remain at our risk until accepted delivery, subject to the CPA.
7. Returns, cooling-off and warranties
Qualifying electronic transactions may be cancelled within the ECTA cooling-off period. The cooling-off right has statutory exceptions, including certain custom or personalised goods and certain services begun with consent. Defective goods and services remain subject to the separate CPA rights described in our Returns & Refund Policy and Warranty Policy.
8. Custom projects and client approvals
Custom 3D printing, scanning, CAD, reverse-engineering, prototyping, laser, CNC, fabrication and production work is supplied against an approved scope, quotation, file, sample or written instruction. You are responsible for checking dimensions, quantities, spelling, artwork, functional requirements and other approval details before production, unless the quotation assigns that verification to us.
We will take reasonable steps to identify obvious feasibility or material risks. Prototypes and first articles may be recommended where fit, finish, tolerances or function cannot be confirmed from the supplied information alone. A client-requested scope change may affect price and timing; we will obtain approval for a material change before proceeding where reasonably practicable.
9. Client-supplied files, samples and intellectual property
You confirm that you own, license or are otherwise authorised to use and instruct us to process any design, logo, artwork, product, sample or other material you provide. You must not ask us to manufacture unlawful, dangerous, counterfeit or infringing items.
You retain rights in your pre-existing material. Create It 3D retains rights in its pre-existing know-how, tools, templates, processes and general production methods. Ownership or licensing of newly created CAD, design or source files is governed by the quotation or separate written agreement. If the quotation states that specified final files transfer to you, transfer occurs after full payment, excluding third-party components and our pre-existing material.
10. Confidentiality
We use client files and project information for quoting, production, support and lawful record-keeping. We may share the minimum necessary information with an assigned designer, supplier or manufacturing service provider. If a project requires special confidentiality, export-control, security or non-disclosure terms, they must be agreed in writing before sensitive material is supplied.
11. Safety, installation and intended use
You must follow manufacturer instructions, warnings, maintenance requirements and applicable laws. Machinery, lasers, CNC equipment, resin systems, heated equipment and engineering parts may require trained operators, ventilation, protective equipment, electrical checks or professional installation.
Tell us before ordering if a custom part is safety-critical, load-bearing, used in a regulated environment or intended for medical, food-contact, aerospace, automotive, pressure, lifting or another high-risk application. We do not certify a part for a regulated or safety-critical use unless that certification is expressly included in a written agreement.
12. Fair allocation of responsibility
Nothing in these terms excludes or restricts liability that cannot lawfully be excluded, including liability for gross negligence or any right or remedy under the CPA or ECTA. To the extent permitted by law, each party is responsible for loss caused by its own breach, negligence or unlawful conduct. Any limitation or risk allocation in a quotation will be interpreted fairly, in plain language and subject to sections 48, 49 and 51 of the CPA.
13. External services and links
The store may link to payment, finance, courier, manufacturer, review, social-media or other third-party services. Their terms and privacy practices apply to their own service. We remain responsible for obligations that South African law places on us as your supplier.
14. Privacy and electronic communications
Our Privacy Policy explains how we process personal information. Transactional messages may be sent where needed for quotations, payments, orders, delivery, warranty or support. You can opt out of marketing messages at any time; essential service communications may continue while an order or support matter is active.
15. Changes to these terms
We may update these terms for future use of the website or future transactions. The terms applicable to an accepted order or project will not be changed retrospectively unless the change is required by law or agreed with you.
16. Governing law and disputes
These terms are governed by South African law. We encourage you to contact us first so that we can resolve a concern promptly. Nothing prevents a consumer from using the National Consumer Commission, a consumer court, an ombud with jurisdiction or another remedy available under law.
